Terms of Service

Please read these terms carefully. By creating an account, or by using Neighborhood Watch (the “App”), you agree to them. If you do not agree, do not create an account or use the App. In these terms, the “Operator” means the individual or individuals who own, develop and run the App, and “Volunteers” means residents who act as Participants, Trusted Reporters, Moderators, Watch Admins or Primary Admins.

1. This is not an emergency service

The App is not monitored around the clock, is not connected to the police, fire or medical services, and must never be used to report or respond to an emergency. Nothing posted here is sent to any authority. Reports may be delayed, may never be reviewed or published, and may be wrong. If you or anyone else is in danger, or a crime is in progress, call 911 (or your local emergency number) immediately. For something that is not an emergency, contact your local police department directly.

2. A free community tool, provided as is

The App is offered free of charge as a courtesy to the community. The Operator is not a security company, a law enforcement agency or a professional service, and does not promise that the App will keep you, your family or your property safe. The App may be changed, interrupted, limited or shut down at any time, for any reason, without notice. Email alerts may be late, filtered as spam or never arrive. Do not rely on the App to make decisions about your safety.

3. Who may use the App

  • You must be at least 18 years old.
  • You must give accurate information about who you are and where you live, and keep it up to date. You may hold only one account.
  • You are responsible for keeping your password secret and for everything that happens under your account.

4. You are responsible for what you post

Everything you submit to the App, including reports, descriptions, photos, places, names and messages (“Your Content”), is your responsibility alone. You, not the Operator, are responsible for Your Content. The Operator does not write, check, verify or endorse anything that users post, and is not responsible for content posted by you or by anyone else.

Only report what you personally saw or heard, and describe it honestly. Do not present guesses, rumors or assumptions as fact. You confirm that you have the right to post Your Content (for example, that you took the photos) and that it does not break any law or anyone's rights.

5. Follow the law and the rules

You agree to obey all applicable laws, rules and regulations (federal, state and local) and these terms whenever you use the App. In particular, you will not:

  • post anything false, misleading or exaggerated, or file a report to harass, embarrass or get someone in trouble;
  • defame, threaten, harass, stalk or intimidate anyone;
  • name, accuse, describe or single out a person in a way that could expose them to harm, or target anyone because of their race, color, religion, national origin, sex, gender identity, sexual orientation, disability, age or any other protected characteristic;
  • post other people's private information, such as home addresses, phone numbers or identifying details, without the right to do so;
  • post anything unlawful, obscene, hateful or exploitative, or anything that infringes someone's rights;
  • confront, follow or take action against anyone yourself, or encourage others to. Report to the proper authorities and let them act;
  • use the App for advertising, political campaigning, spam or any commercial purpose, or misuse invitations to contact people who have not asked to hear from you;
  • use someone else's identity, create a false account, or try to get into accounts, data or systems that are not yours;
  • interfere with the App or its moderation, scrape it, probe it for weaknesses, or use it to plan or commit a crime.

6. Moderation, suspension and bans

The Operator and the Volunteers who run each watch may, but are not required to, review, edit, decline to publish or remove any content, and may restrict, suspend or permanently ban any user at any time, with or without notice, for any reason they consider appropriate. Breaking the law or these terms will result in permanent suspension from the App. The Operator may report unlawful activity to the authorities and may cooperate with law enforcement and legal process, including by disclosing information when the law requires it or when needed to protect people's safety or rights. You have no right to have anything published, and decisions about content and accounts are final to the extent the law allows.

7. Volunteers are neighbors, not the Operator

Participants, Trusted Reporters, Moderators and Admins are unpaid volunteers. They are not employees, agents or representatives of the Operator, and what they post, publish, decide or fail to do is their own. The Operator is not responsible for their actions or inactions.

8. Your content and our right to show it

You keep ownership of Your Content. You give the Operator a non-exclusive, worldwide, royalty-free licence to host, store, copy, display and send it as the App works, including to other residents, to administrators and in email alerts. The Operator may remove Your Content at any time.

9. Your information and the Privacy Policy

To run the App we collect your name, email address and home address, an optional phone number, and what you submit. Your address is used to find your neighborhood watch and is visible only to you and to administrators who need it. Other residents see a shortened version of your name, and a general place rather than an exact pin. Photos have their location data removed. We do not sell your information. We share it with the services that help us run the App (hosting, email, maps and address lookup), and as described in section 6. No system is perfectly secure, and Volunteers who can see members' details are asked to keep them private, but the Operator cannot guarantee that they will. The Privacy Policy, which forms part of these terms, explains this in full, including how to ask for content or information to be removed or for your account to be deleted.

10. Other companies' services

The App relies on services run by others, such as hosting, email, maps and address lookup. The Operator is not responsible for them, and their own terms apply to them.

11. No warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT THE LAW ALLOWS, THE OPERATOR DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, SAFETY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

12. Limit of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, THE OPERATOR, AND THE OPERATOR'S DEVELOPERS, OWNERS, FAMILY MEMBERS, HEIRS, AGENTS AND THE VOLUNTEERS (TOGETHER, THE “RELEASED PARTIES”) ARE NOT LIABLE FOR ANY INJURY, DEATH, PROPERTY DAMAGE, LOSS OF DATA, HARM TO REPUTATION OR OTHER LOSS, OR FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING FROM OR RELATED TO THE APP. THIS INCLUDES YOUR USE OF OR INABILITY TO USE THE APP, ANYTHING POSTED OR NOT POSTED BY ANYONE, ANYONE'S CONDUCT, AND ANY DELAY, ERROR, OUTAGE OR FAILURE TO PUBLISH OR DELIVER A REPORT OR ALERT, EVEN IF THE POSSIBILITY OF SUCH LOSS WAS MENTIONED. THE APP IS FREE, AND IF ANY LIABILITY IS FOUND DESPITE THESE TERMS, THE TOTAL LIABILITY OF ALL RELEASED PARTIES TOGETHER WILL NOT EXCEED US $100. Some places do not allow certain limits, so these limits apply only as far as the law permits.

13. Your release

You release and forever discharge the Released Parties from all claims, demands, damages and causes of action of every kind, known or unknown, that arise out of or relate to your use of the App, Your Content, the content or conduct of other users or Volunteers, or any dispute you have with another user. You understand that this release covers claims you do not know about today.

14. You will cover claims caused by you

You agree to defend, indemnify and hold harmless the Released Parties from any claim, liability, damage, loss or expense, including reasonable attorneys' fees, arising from Your Content, your use of the App, your breach of these terms or the law, or your violation of anyone else's rights.

15. Changes

The Operator may change these terms or the App at any time. When the terms change in a way that matters, you will be asked to accept the new version before you continue using the App. If you do not accept, you may not use it.

16. Ending your use

You may stop using the App at any time. The Operator may suspend or end your access at any time, as described in section 6. Sections 4, 5, 6 and 8 to 17 continue to apply after your access ends.

17. Governing law and the rest of the agreement

These terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules, and any dispute will be brought only in the state or federal courts located in Ohio. These terms are the whole agreement between you and the Operator about the App. If a part of them is found unenforceable, the rest still applies. Not enforcing a term is not a waiver of it.
